ADGM publishes new employment regulations, to become effective on April 1

Abstract: ADGM releases new Employment Regulations for 2025, updating work practices, clarifying rights, and including remote work. Effective April 1, 2025.

The Registration Authority of the Abu Dhabi Global Market (ADGM) recently released the "Employment Regulations 2024," which reflect changes in global workplace practices. The new regulations aim to provide employers and employees with clearer provisions regarding their rights and obligations, and to promote and foster best employment practices within ADGM.

Hamad Sayah Al Mazrouei, CEO of the ADGM Registration Authority, stated, "We are delighted to announce the release of the new Employment Regulations, which demonstrates our firm commitment to strengthening the ecosystem and providing companies and employees with the best regulatory framework and favorable conditions."

The new Employment Regulations will come into effect on April 1, 2025, replacing the existing "Employment Regulations 2019." This will give employers ample time to adjust their internal policies, employment contracts, and other employment-related matters to comply with the requirements of the new regulations.

Some key revisions made by ADGM in the new Employment Regulations include modifying the definition of "employee" to enable employers to hire remote employees and allow for more flexible work arrangements. The new regulations also clarify ambiguities related to employee rights, including the rights of part-time employees, and certain requirements regarding obtaining and canceling employee work permits and visas. In addition, ADGM has expanded the obligations and responsibilities related to workplace discrimination and victimization.

ADGM's new Employment Regulations include 13 parts, covering revisions to the process of employing staff (including part-time and remote employees). The regulations also cover wage protection, working hours and leave, parental rights, employee dismissal, and employer obligations, among other topics.
